Pictures of Minors on Facebook without parental consent


What is the name of your state (only U.S. law)? Wisconsin

Is there a law against or any action that can be taken if an adult has pictures of your minor children posted on her Facebook page?

These were pictures that she took at a camp, so they are her property, but she was asked by several of the parents of some of the children she took pictures of, to remove them from her Facebook page. She refuses to.

Is there anything that can be done? Is there any legal action or is she violating any laws?

I cannot point to any law to support such a demand but just as an attempt to try to have the pics removed, has anybody contacted Facebook and asked or demanded the pics be taken down?

I suspect there may be some legal support. I just do not know what it is at the moment. There are others here that may be able to help more.

Ok...laws pertaining to any picture of a minor posted on an adult meaning over 18 by definition of the State of Wisconsin, would mean unless it's child pornography, the most you might have is an invasion of privacy case. And...chances are, since it's a "she", that may not go very far either... But I dont know. You need to pay attention to the Terms of Service (terms and conditions of facebook) and special attention to posting prohibited, or suggestive media. Anything like that will help your case. Having minors in the line/field of the camera view when the pics were taken is not a valid case in itself if they are being posted as the originals; however, if they are manipulated in any way, that is potentially illegal. If the child chose to be in the picture at the time they were being taken, I dont think there is much you can do.

Like above, consider using the Report button on the facebook website, it'll get you farther than you think. Almost every picture of a minor that was unauthorized for posting by a concerned parent has been able to be removed through the websites moderators. Explain the story to them and most likey they're forced to remove it rather than support one member in court. The other alternative would be to get a restraining order on behalf of the individual on the individual depending on the circumstances, assuming this person is not a direct relative of the minors involved, you would have to seek a RO on the basis of Repeat Violence. And You would have to prove that the child(ren) were in direct danger of the photographer by posting these images. Personally I think that's a little unnecessary...

Why is she being asked to remove the photos?
