What is the name of your state (only U.S. law)? n/a

If my design includes the RSS Feed Icon as the main focus (but not as the main subject) and is only seen in less than 20% of the design as a small element or if the Feed Icon is broken up in half or a few pieces, would that go against Mozilla's Feed Icon Guidelines: http://www.mozilla.org/foundation/feed-icon-guidelines/faq.html ? The design would be sold.

Checking iStockphoto, there are already people who sell the actual icon file with little to no added design or artwork: http://www.istockphoto.com/file_search.php?action=file&text=rss+feed+icon
If that is going on, then what is stopping others from making RSS Feed Icon designs and selling them as t-shirts on CafePress?

No. The proposed usage guidelines are not legally binding in any way. However we hope that users of the icon will honor the guidelines in the spirit in which they were intended.
You want to know one reason why the open-source community has no moral outrage against software pirates? Because commercial people have been ripping them off for years. You might as well do it, if every other half-a**ed developer and salesman is, right?
