Assessment Check Refund- Who's is It?

CA- I received a refund check on an assessment that was done before I bought my condo. The check is in my name and the HOA says to forward it to the previous owner and they are not responsible. Can I keep this check? Can the previous owner sue me? The check is for $3K

**A: what did your purchase contract state with respect to this issue?
