Massachusetts - Have any laws been broken when a condo association board member is also a realtor representing sellers in that complex, and having those units that are for sale (specifically those units represented by this person) reshingled etc. before other units in the complex which were ahead on the list? Making these units that are represented by the board member more attractive to potential buyers at the expense of the residents (an assessment) is resulting in this board member profiting (real estate commission) from this person's own influence.What is the name of your state?

This is definitely a conflict of interest. The person should remove themselves, or be removed from the board, pronto.

What did the President say about this when you complained about it? Furthermore, the President is the one with the authority to tell contractors what repairs are to be done and in what order.
The president of the board is new this year and doesn't have forceful enough nature to do anything about this. In other words, the president is not leading. Other people have complained as well but to no avail.

What I am trying to figure out is if we could take legal action to remove the treasurer or if we need to wait until the term is up. And also if we could recover any profits made from the sale of units by this treasurer where special work was done to these units in order to make the sale.

This went on where I live. The board VP was a big time realtor. The Pres did what ever she wanted. She had most of the elderly convinced that they had to use her to list the condo. No one said anything for years and the other board members were all friends. Some things are just now coming to light. They definitely prioritized things like waterproofing their own basements while refusing to waterproof others, and exterior repairs.


They all ended up moving out at the same time. Our termite letter was no good (guy had not treated or inspected and he was referred by the realator) Assoc. was out thousands, but these folks were long gone. Next board said that the Lawyers for the ASSOC. said not to go after them.

Scream and Holler - Call the Real Estate Board of your state. File a complaint. Inform your neighbors (if they will listen).

Read your By-Laws to find info about removing BOD members.

How do you know the treasurer/realtor is using the HOA's monies other than what the HOA is supposed to use for common elements? Don't be a rumor-monger WITHOUT facts backed up by documentation!
