BOARD refuse to arrange for water damage to be repairedWhat is the name of your state (only U.S. law)? New York City My co-op board refuses to arrange for water damage to my ceiling to be repaired because it's result of upstairs people being negligent, even though I have suffered same kind of damage multiple times in last 2 years. Board sent a letter to upstairs people as a warning. However, Board refuse to get involved in the assessment and repair of the damage. Instead, they told me to arrange for someone to fix the ceiling myself, and to check for mold. I reminded them that there may be mold between floors. They said they did not have the time and financial resource to check mold now. My question: shouldn't the co-op be responsible for arranging the repair and check for mold, and then bill the offender? |

At worst, you can always fix the damage yourself and sue the neighbors/board for reimbursement. (In fact, if they don't fix it, you are required to mitigate your damages anyway, so might want to start looking for a drywall/painting/mold testing contractor now).
