I would assume the developer absolutely could do this. Developers often have representation on HOA Boards until the development is turned over to the HOA. I think we all acknowledge that HOA Boards should represent residents or land owners in a development. Well if a developer still owns 30%, 50% or even more of the lots, then you would think they have the right to have their interests looked out for.
