I am involved with a condo association that had hurricane Ivan damage. I purchased two weeks after the hurricane damaged the building. The president of the condo association handling the repairs is an insurance adjuster, for another company because of his "insurance and repair knowledge" he would head up the repairs. I spoke with him about purchasing the condo, he told me, my realtor and the person I purchased the condo from because of his experience in the insurance field that the restoration cost would be more than $20,000 and complete in 6 months. This is what I based the purchase on, the seller agreed to pay up to $10,000 of restoration cost within a nine month period. The president assured us he was and insurance adjuster he knew what he was talking about and handled these cases all of the time. The president of the association gets us crossed up with the insurance; we are involved in a law suit with the builder and the insurance. 33 months later each owner is being accessed for $100,000 and has been unable to use our condo for 33 months. Can I sue this guy for misrepresenting himself and the facts he is an adjuster for another well known company. I am sure they would not be happy with him; he kept mentioning their name during this, is he required to have a bond or insurance or licensed. Although he was not acting on the behalf of the company he works for, he kept throwing their name around and telling us how they would do it, and that he had been there for 28 years. Would they have any responsibility, or consider it a conflict of interest, with the actions he took while being there employee. I feel like with him being an employee and advising people on insurance matters would hold them partially responsible. This has caused great hardship on me mentally and financially. Pay for a place that you can not use. |
