Condo Age Restrictions


What is the name of your state? CT

Our 3 year old condo complex by laws state that one member of the household must be 55 years old. Now the board wants to change that so that no resident can be under 21 years of age. My objection is that were a tragedy cause me to find myself raising a grandchild, I would have 30 days to move. This seems a bit harsh to me. Is there anything discriminatory about this kind of condo rule? At a recent meeting the majority did vote to eliminate the possibility of children living there.What is the name of your state?

A: Yes. But it's not illegal.

You may want to check the legality of applying that deed restriction to partys who already own. It may need to apply to all subsequent purchases. Read your condo docs- its is probably something the bioard cannot simply impose without a certain percentage of owners agreeing.

Odds are, their intent is to prevent residence by families such as mine, in which one or both parents (not even grandparents, mind you) of kids under 10 are older than age 55. Under present bylaws, we could legally live there, for example, along with our eight year old because hubbby is older than 55.

This is very common, many communities have a rule that no one under 21 or sometimes 18 my live there, and that one person has to be over 55. If this was properly voted upon and the amendment carried, there is nothing wrong with what the board is doing. These people within your community obviously moved there to have peace and quite and feel the need to prevent the possibility of your grandchildren living there and ruining that for them.
