condo fee lawsuit question


Heres the issue going on.

We fell behind on a few condo fees but were still making attempts to pay. We fell behind by 3 months, but sent in a check for 1 of the months. then followed up w/ a money order since they take forever to cash them. a month or so goes by and we get court papers saying we owe X amount and that we arent paying on time..ect
To find out..the check we sent out ended up going to a lock box somewhere else (even though we used their return envol.) and never cashed the money order.

my big problem is that now we owe over a G in extra fees..lawyer..court..ect. WTF! We never recieved any leter saying this would happen, otherwise we wouldve responded earlier.
Arent they (the condo ass.) liable for those fees since they never sent us that letter? most places send a certified letter. They said it was sent but we never got that.

we have the money to pay up on everything but i dont feel like we should have tp pay the lawyer fees since they dropped the ball.

any help would be great. thanks!

**A: read your condo docs. The HOA has a right to hire an attorney if you have not paid.
The onus is on you to make sure they got the money. You should have hand delivered the money to their office or wired the funds if you are out of town. You owe the legal fees. It is already stated in your condo docs. Read them.

oh please. Im not about to drop off their $$ to them. The $$ was sent in their env. they mail out to us. They are the ones who screwed that one up, not us. Arent they supposed to give us some sort of warning that payments are late..ect? nothing was mentioned intill we got the court letter. My wife was told they sent out a warning type letter but that was never received. Shouldn't it have been certified?
