Condo Owner is Harrassing Other Owners


What is the name of your state (only U.S. law)? IL

I am the president of a self managed 6 unit condo building in Chicago. We have an owner in our building who has been harrassing other owners in the building. He makes intimidating statements and critical remaks to people.

He treats people in a threating way. He is acting like a bully.

He has been verbally abusive to people. When people in the building tell him to stop he continues to knock on their doors and confront them, even when asked not to do so. Some times he will make phone calls to them.

I have been reading our rules and reg's and we have nothing that covers this kind of situation. I have been thinking that we need to update our rules and regs to cover harrassement. Then we could fine him for this kind of thing.

He has refused to cooperate with the board on a number of issues.

Do you have any other suggestions for us?

**A: the Board needs to seek legal counsel on this matter. Hire an attorney asap.

We had a similar situation at our HOA. The first thing we did, as a board, was to call the Police. We had a meeting of the Board with the Police Chief. We were told that Harassment is illegal and the police should be called immediately.

We were also told that if the Police can document a pattern of harassment, it could quickly become a case of Stalking. Stalking is an indictable offense and is taken very seriously by the courts.

If you or anyone is threatened for any reason, call 911 and file a complaint with the responding officer.

Living in an HOA does not mean you no longer have Police protection!

Once you have filed police complaints and have a documented history of this bullying, you can try to get a restraining order against the offender.

Regardless of your Rules and Regulations, each resident of the HOA is still subject to the law.
