Condo ownership dispute in Georgia


What is the name of your state? Ga

A lady friend of mine lives in Florida, but recently bought a condo here in the Atlanta area as investment property. I needed a place to stay after selling my house, so I moved into her place rent-free since she paid cash for the place at an auction in exchange for fixing up the place a little. The condo association almost immediately started harrassing her for "renting" out the place to a non-owner. We went to see a lawyer and even talked with the association's board. The board suggested we show some type of ownership for me or else I would have to move out. We got a quit claim deed that shows me with 1/100 ownership rights. We gave this to the board and they turned it down because they said this was just done to allow me to stay there by circumventing their rules. They said they would start fining us $25 a day until I move out. Help! Can the board do this even though I am part-owner of the condo via the quit claim deed? There's nothing in the CC&R that says only 100% owners can occupy the unit, it just says only owners can occupy a unit. A lawyer friend of mine says the association is wrong in this case and they could be sued if they continue this harrassment. Is he right? Appreciate any help with this.

A: I haven't read the CCRs. Has the lawyer read the CCRs and done his research on similar cases in your jurisdiction?
