A former owner of several condos at our condominium claims she retains rights to common area storage units because the original CCRs identified her as the person who would decide their use. She is suing the HOA for $50,000 even though she has not owned any property at the condominium for 6 years.
The storage units are indentified as part of the common area.The judge hearing the case has asked for plaintiff and defendant (us) to provide him with appropriate Utah law to decide the case. We, the management committee, do not see how there can be any law supporting her position if she owns no property as determined by a deed search. Are we correct?What is the name of your state? |
