condominium law homeowner association dues


Connecticut (Fairfield County)


Owner moved out, we cannot locate her. She stopped paying her mortgage and homeowners association dues. The condominium association placed a lien on her property for non payment of association fees and assessments. Her attorney moved into her condo, will not tell us how to contact the owner. He made up a monthly lease showing that he pays one dollar a month for rent, and he pays no homeowners association fees.

Is there anyway we can make the renter pay the homeowners association fees? Do we have to change the bylaws for this? Is there anyway can we legally have him evicted?

Renters are not members of HOAs; therefore, not responsible for paying HOA fees. When the HOA forecloses on the the unit, the tenant can be evicted.

It is apparant that the HOA legal counsel needs to get involved to commence legal action to foreclose on the property.
