contract addendum


Florida

I purchased a pre construction condo over 2 years ago and the contract was asiagnable and I sold the contract to someone else about 6 months ago. The builder has recently made some changes to the condo docs giving everyone 15 days to back out. My buyer threated me and made me take money off the price of the condo or they wouldnt close. After much arguing I took $35000 of the price of the condo. I had them sign an addendum stating that by signing the addendum they meet there 15 days to cancel and under no cuircumstances can the cancel there contract with the builder or myself and they give up all there cancelation rights under any florida stautes. Now I am forced to close in less than 2 weeks. Can I sue them to get back my closing costs, mortgage payments while I am trying to sell it, monthly HOA fees, commision that I will have to pay to sell it or any other expenses I may incur now that im forced to close. Arent they in breech of the contract since they signed the addendum.

What costs are you incurring? Your buyers are closing right? Try again and explain what exactly is the problem.

my buyers canceled the contract with the builder last night on day 15 of there right to cancel even know they agreed to close and not cancel under any circumstances. So now I have to close on the unit and I will incure closing costs, mortgage payments, Monthly HOA fees until I am able to sell it.
In the addendum to the contract it say "by signing this addendum it meets there 15 day right to cancel and under no circumstances can they cancel" they agreed to this so I had reasurance that they would actualy close. but for some reason they dont feel that they need to comply with the contract they signed. Now I am in a scramble trying to get a mortgage and close on the unit inunder 2 weeks or the builder takes back the unit and im out the money i would have made
