I am a member of a small self run HOA of 5 units. All owners are members of the board.

Early last year we voted for an assessment that all except on member has paid off completely. It was unanimously voted for. This member is in the process of suing her sellers because the assessment is related to repairs for damage that was not disclosed to her. When she vote for the assessment she verbally specified that she would have difficulty paying until her lawsuit has been settled.

Are there any online resources any of you can recommend for guidance in helping us write up a contract for repayment of this debt? We have limited financial resources and would like to handle ourselves but want to make sure we are covering all of our bases so that if the assessment is not paid within the guidelines we can legally enforce it without her having much grounds for dispute.

Our CC & R's do clearly allow for a lien to be placed on a unit for an unpaid assessment but we are looking to try to put together a payment schedule or timeline first to try to resolve the issue and then resort to a lien if the agreement is defaulted on.
