Hardwood Floors installed without Permission

Our building has an Owner who requested to install hardwood floors a couple of months ago. The Owner was told by the board, that per the HOA rules, hardwood floors were not allowed. A few weeks went by, and carpeting was spotted in the dumpster by another owner, but unfortunately this was not reported until some time later.

A few more weeks passed, and the tenant below began complaining about loud banging noises from this Owner's unit. The noise was evidently characteristic of hard soled shoes on a hard surface. The Owner was asked about it, was unapologetic and adamantly denied that they had hardwood floors. When asked by the board if it could inspect to verify that hardwood floors hadn't been installed, the Owner initially agreed, but failed to show up at the predetermined time. When approached later to reschedule, the Owner angrily stated that they felt they were being harassed by the board on the issue and were going to contact an attorney and sue.

Any thoughts as to what the best next course of action should be from the board? If legal action is taken, should it come from the board… or the tenant below?

**A: the HOA should take legal action and the tenant of the unit below used as a testifying witness.
