Help needed with petition submitted to Board of Directors/Management Company


What is the name of your state? Florida

We have a serious problem here in our condo. We have board members writing checks to homeowners for all kinds of reasons and we reported them to various agencies so of course they are angry. Well now they are getting pay back. We submitted a petition back in Oct to the management company that runs our condo.
The owners back in Oct handed PAMI Management, the management company that runs our condo, a petition to be put up for a vote at our annual meeting in Jan 07. It was to vote on change in the docs on pets. Per the statutes there were more then enough signatures on this petition to bring it up for a vote at the annual. Well the 2nd mailings went out to the owners and the issue that the petition covered was not included for the people to vote on or for them to send proxies in to be voted on.

Now this was purposely left out because I was the one that spearheaded the petition and they are trying to get back at me for reporting the board members and their friends for misappropriation of association funds. What legal recourse do we have to get this put into the meeting in Jan and to fine them or hold them accountable? I have been dealing with someone at the Department of Business and Professional Regulation on the other issues.
The person who is handling the money issues told me they cant do this I have to open a new case but the waiting persiod is very long and the meeting is next month and we need to stall it due to the lack of notice.
Isn't what the management company and the president did by not including the petition illegal? What can be done to get them to resend the 2nd notice for the owners to have a chance to vote on an issue that people want to have a say. If this doesn't go for a vote then people that are in "violation" will be fined and after years of no one doing anything to the people that are in violation, the new board and management company are cracking down and that was why the people got the petition up in the 1st place.

Just last wed we had our monthly meeting and the president wanted to vote on a special assessment for supposedly to cover the rising cost of insurance. Well I pulled out our doc and had to show the president and the management company that in order to do a "special Assessment" home owners had to be given 14 days notice. When the president took the docs and read it he said well this applies only to "emergency" assessments. AT that point I pointed out he just got through saying that this was an emergency and had to be done. I also pointed out that it was on tape not only by him but by my recorder that was there with me. See this is what I am telling you. I speak out and they stall me every chance they get like with this petition. I stopped the assessment until the owners could be notified but we need the petition to be on the ballot.

Please help us. We are in such a mess with the board giving monies collected for assessments to other homeowners with no proof why and to themselves for reimbursements for things with no receipts and now ignoring petitions that come to them per the statutes.
Please help us.

Obviously you are getting no where yourself so I suggest you seek the advice of an Atty versed in these issues. If others are just as upset as you are then split the cost of the Atty.

The 14 day notice applies to NON emergency special assessments. We have the same thing going on. Find out when they received the premium for the insurance and when it is due.
