HOA fence rules


What is the name of your state? South Carolina

I built a fence around my property with in the guide lines of our covenants including paperwork given to me by the HOA. They have since told me that I must paint my fence white. There is no mention of paint color in the covenants, or in he paper work I signed.
All I want is to stain and seal my fence a natural color. The HOA has threatened others to paint their fences and they complied. Now the HOA is afraid of getting sued by them if the HOA doesn't make me paint mine. Do I have a leg to stand on in my fight to stain my fence.

**A: request in writing the fence painting color white requirement that should be part of the Declaration, Community Rules or Architectural Design Guidelines

There is no mention of color, type of fences in the covenants (IE wood, vinyl, chain link). Ony height and boundry restriction.

What HG means is that you request it from them. If it's not in there, then you are good to go.
