HOA parking restrictions

We have 2 cars and a motorcycle. One driver has a permanent Handicap and a placard issued by the state. The car driven by the handicap person parks in guest parking because trying to park in a 2 car garage does not offer enough room to enter and exit safely, not to mention there is not enough room for all 3 motor vehicles. The HOA does not have any Handicap spaces in the whole development (150) So now to my question.... the HOA is telling us that they don't care about the handicapped person and to park in the garage including the motorcycle which they don't recognize as a motor vehicle, rules stating that 2 motor vehicles must park in the garage before they will give you a parking permit to park in the guest parking. There is not 2 feet between cars forgetting about the motorcycle and a handicap driver needs 4' all the way around. There are plenty of spaces that are empty especially at night. what are our rights?

so what you are saying is that the person with the handicap plate needs 4ft on all sides to get into out of the car and it would take having only that car in the garage to do that.

But that the HOA states that their rules say you must park both cars in there before they will ok you parking a car on in the guest area.

1st thing 1st dose the HOA have a process to require a waver to bypass this? and if so have you done it? as this would be your 1st step.

After that you can check what your local and state laws are on what HOA are required to do for handicap people. Your local code enforcement should have this information for you. If code enforcement dose not you can try you local DMV. I know where I live the local DMV has paper work stating what all the laws are in respect to cars with handicap plates and what state department enforces them.

Yep the HOA is saying that there must be 2 motor vehicles in the garage before
they will issue a PP. They don't recognize handicap parking dimensions in a garage or that they need to give a waiver. and they don't recognize the motorcycle as a motor vehicle. Further more they don't recognize the Placard for the purpose of parking in the garage per the rules and regs. The State of Calif. states that a handicap space have 4' between and 19' clearance front to back.
