HOA wrongly accuses me of trash violation


California.

I am a responsible condo owner who owns in a large complex. I have owned here for 11 years. For years, all was well, quiet and peaceful. Within the last two years, our board (that which never turns over and fixes their own places with glee, all using HOA money ... a different topic) hired a new management company.

The owner of the management company and I got off on the wrong foot. He was very rude to me when I had a roof leak and he took it upon himself to make sure it took five months to fix.

It has gone from bad to worse. He sent me a very vicious letter that the silver trim on my 11-year old cat door wasn't painted brown to match all the old brown aluminum windows we have. It's been there 11 years! You'd have to be on a ladder to see this door. Within two weeks, I got another letter about this, summoning me to the board. I wrote him back one nasty mo-fo letter and painted it.

Then he wrote me a letter accusing me of destroying my garden fence. Huh? I brought this rotting fence to his attention! But he forgot that and my letter to the board must have embarrassed him. It was fixed for free, but then he had the gardeners cut down all the trees and bushes in front of my condo. Accidentally he said. He destroyed two baby bird nests.

Now and for the last year, I have gotten five letters from him, claiming that "other owners" are complaining that I am filling and using their trash and recycle bins. It's 100% made up out of whole cloth. In fact, others use my trash often and it's disgusting.

About nine months ago, I saw the husband of a board member throw a huge box in the street from his recycle bin, as he cursed at the box. I guess it wasn't his! It was pick-up day. I went outside and put it in the first bin I could find to get it off the street. It was picked up in an hour.

But someone saw this, I guess, and I got my first trash letter shorly thereafter. I wrote a letter explaining what happened and that the husband threw it in the first place. But then the letters escalated and today I got a $50 fine assessment against my condo.

The management company claims that they have complaints against me, with photos (!), and that I am not entitled to know who complained, or when, or what these photos are. Accused -- guilty.

Now I think I need to sue them for harassment. My trash is completely and under control. I live by myself for God's sake. But this is "their thing." I will not sell. They can all burn in hell first.

I don't care if suing bankrupts the HOA. It would be my pleasure to take them all to superior court and sue for heavy money damages. It may be the only thing to stop their rampage. I see so much crap on balconies, trash overflowing and believe that those are not being addressed. Just me and their made-up issues about me.

Does anyone have any advice about my situation? I am a successful and responsible real estate agent and have never had a legal battle. This is out of left field but the HOA and all members are unresponsive to my letters. They're all ignorant, power-hungry maniacs in my opinion.
