Question

Home owners Association going after us to fix roof and neighor also asking the same


What is the name of your state? Fla We bought our condo 5years ago the inspector did a rush job when going up on the roof. During the storm season we recieve some damage. We are still trying to fix the roof but did not get enough money to fix it. Base on the estimates that the roofers are coming by to give us. Which is like $3000 to 4000 dollar we only got $1000 dollars to fix it from the insurance company. Homeowner association is going after us to fix the roof. One of the roofers told us that the shingles that are on our roof had a class action suit on them back in the later part of the nineties. Had gotten some information before that that the lady that live here had a law suit on this roof and she did not fix it and took the money instead. By law how much time can we take to fix our damages, we have also been in a bankupcty and our case was just dismiss and we are trying to refinance our home and look into any legal rights that we have to go after the woman that lived here that did not fix the roof and the inspector that inspected the roof also. But the homeowners association does not know that we are trying to do these movement because we are not ready to tell them this. If we keep giving them in writing without a date that we are looking into fixing our roof. Can they just keep sending us violation about fixing it and by law can they come and take pictures of our property the board members that live in the subdivision is that legal for them to do that or come in our gate is that not trepassing on property with code enforcement. Our neighbor also his house is connected to ours his house is up stairs and downstair. Our neighors roof is high and you can see the side of his house he as sent us a letter stating that he would like to fix his siding on his house and the man that needs to get up there needs to get up on our roof to do it. But he does not want to because he does not want to fall through. Neighbor is also stating to us that the damage is such to our roof that because his fireplace wall is next to damage area on our roof and the water coming into our roof might start leaking into his firewall into his place causing damage that his insurance company is not going ot pay for. What can we do about all of this because we are waiting for the things that I mention up above the inspector and the lady that live here to see if we have any legal rights because he did not come forth and tell us from the beginning that the roof had a problem when inspecting it and she did not fix the situation but left a damage roof up there also. Our neighbor also has told us that something was wrong with the roof before. How can we take care of this situation legally

**A: you owe and have a duty to the HOA to fix the roof NOW.

I agree and just want to add that all this was in your CCRs.

(And I don't mean your Creedence Clearwater Revival albums....)
