What is the name of your state (only U.S. law)? Missouri

I live in a Condo, our bylaws say you CAN NOT rent. We have a person that bought a house and is renting the condo out to a friend. When we approach her she said she is moving back. She is lieing. She has been caught renting 2 times before and the renter had to leave. This time is different, she said she moved back in July, she did not, she lives in her house that she has redone and also taking care of her mother who is ill.

How can we prove she is not living there????????????:

Thank you
Shirley

That's not a legal question. Don't look to what you can't prove, but what you can. Prove she lives somewhere else and not that she doesn't live at the condo. Also, "living at" is not really a legal term. What do the organizing documents say? The concept of residence is legal in other arenas, but you wouldn't want that definition as it sometimes includes intentions. Intentions for the future are hard to refute.

**A: the Board should get legal counsel involved at this point.

Your situation has absolutely no bearing on this and is totally irrelevant. Why even bring it up?
