I've recently joined the board of directors for a 40 hoa. According to the by-laws, no addition of landscaping or plants are to be put in by unit owners in the common element area. The hoa is 3-4 yrs old and prior to this last fall, no other board has taken action against some owners who have added and changed the look of their propery by adding vines with trellis, vegetable plants , spot lights focused on their units as well as solar lights. Now the new board would like all these infractions corrected but are getting flak from the same owners who feel like they have the right to continue with these infractions since no one said anything before. We are having an executive board meeting on Monday and would like to know if these infractions are not corrected who will incur the costs to remove the above mentioned items and if the owners want to change this by law who pays for that

just remember that if you want to continue being on the board, you may get voted out if there are enough angry tomato growers out there. you need to go through your management company and the owners should be responsible. but is it really that big a deal?
