Maintenance Building built 70feet from our condo!!


What is the name of your state? Pennsylvania
We own a condo in PA. A little over two years ago the management (without informing the condo owners) built a 100ft x 40ft Pole building that was meant to store the grounds equipment. Our condo is an end unit. They paved a road along side the unit (20ft) that goes back to the building. We hear all the traffic and all the noise from the buidling and from the workers, they work 7:00am - 3:30pm

Over the past 2 years the noise has progressively gotten worse with the addition of new industrial type equipment and more workers.
We have dealt with blaring music, yelling, bull dozers pushing mulch around and loading it into trucks, slamming truck doors, power washers, blowers, extremly loud riding mowers, tractor that they use to drive back and forth on, cursing, slaming tools into the metal truckbeds, plus the constant noise of them driving in and out all day long every 5, 15, 20 minutes back and forth.
So far, this year, we have been sleep deprived since March when the bull dozing the the mulch began at 7:00am. We are stressed to the max and beginning to develope post tramatic stress disorder from the noise. The decible levels of 90% of the equipment and tractor, mowers is around 70 - 80 decibles INSIDE our home.

We have tried to speak with the property manager and were told things like: "if you don't like it move", "I can stand at your window with a jack hammer from 7am to 10pm and you can't do anything about it". We then went to the Monthly board meeting and after hearing the property manager yell and intimidate everyone we requested a private board meeting in order to present our issues. We contacted the police to find out our rights. We researched the noise ordinances, we have video (police suggested) to show the noise levels. When watching the video back we found that the workers were purposely making noise to bother us (slamming wheel barrows 6 or seven times on the ground, throwing equipment, yelling etc...). We went to our private meeting with the board and stepped into a complete interogation where we never got to present our case or show our video for the nosie levels. We were treated like criminals on trial and all they wanted to do was make us meet with the property manager right then face to face. The property manager IS the problem. The board has never even acknowledged any of our issues.

In the condo's declaration it states "at no time hereafter shall any person or persons acting under him use any object or thing which creates noise, smoke, odor, soot or vibrations in such a manner as to disturb any other owner or lawful user of the grounds"

Obvioulsy the workers do no have to follow this even though any other person or party who comes into this development must.

We understand that they have to work and we don't expect to have no noise. We have asked them to do things like power washing or bull dozing later in the day. To please consider the residents in the early morning hours. They are unwilling to compromise and have taken to harrassing us with further noise and made up complaints. We have never spoken with the workers so any animosity or harrassment is being directed and incited by the property manager.

We do not have the money to hire a lawyer and as far as I can see the only other option is to file a harrassment, disorderly conduct complaint at the district justices office.

This has ruined our home life. One of us is, or I should say, WAS a musican who works and records at home. I do not think that we should be forced to move from our home by WORKERS or MANAGEMENT. We did try to speak to a lawyer but was told that "they have to do their work"

Any suggestions?
