Making all common areas of condo complex "non smoking"

Just curious if anyone has had experience with making all common areas like hallways, grassy areas, driveways, "non smoking". Lots of complaints about cig butts in front of a couple of units and the board is looking at this as a way to try to manage the problem. Thanks...Ted

**A: have the Board do a resolution non smoking in common areas or within 20 feet drafted by HOA legal counsel.

The hallways might be easier than you think , contact your city / or your fire dept to learn about regulations pertaining to smoking in the halls , If people are tossing butts on the ground they might be more than willing to use one of them freestanding butt can post to put butts into. its easy enough to place them a certain distance from doorways so as people are coming in they can easily finish smoking and toss the butt in the hole. (it might be a lower cost way to go if the HOA doesnt want to go to the final expense of having its atty review new rules. If your city / county / state laws forbid smoking in the hallways then your only cost is signage and letters to inform every one of the law.

Hello, your idea about butt containers was brought up and a surprising number of people reacted by saying that they are an eyesore and we do not want them outside the units and also that those who are tossing the butts will ignore the containers. I agree it is an option, but most folks do not want them...

FYI - Making the complex non-smoking will NOT eliminate cigarette butts and will not end the need to clean them up.

If the board thinks the new policy will eliminate the number of butts or the need for cleaning, they are deluding themselves.

We passed a new rule (Board was allowed to create rules/regs without an owner vote) banning smoking in all common areas except for designated "smoking zones" -- pool area and rooftop deck (we put in ash cans) or the parking lot (some butts did end up on the ground, maintenance guy had to clean up). Before we created the new rule, the Board had asked for a show of hands at the annual owners' meeting, and the majority were in favor. No one wanted smokers standing in front of their units, smoke wafting in their windows, etc.
