Neighbor strews garbage in hallway


What is the name of your state? New York

There are seven apartments on each floor. I happen to be the only original tenant in a Mitchell-Lama co-op development of 520 apartments. I've seen them come and go from the apartment next door but this one's a dilly. I've never had a problem with anyone living in this development until now.

Aside from 3 rambunctious, out of control little girls with no father figure in their lives used to bang on the walls for no reason, well still do except not to that din, me and the other decent stockholders on this floor are sick and tired of seeing garbage, and human waste, such as spit on the inside hallway window, chewed gum being spit out and stepped on the polished floor right in front of a longtime tenant's door right next to ours, a constant stream of trash being left on our floors...

At a "gripe" meeting held by the Board of Directors a couple of weeks ago, this woman declares, twice, in front of many people, her rent has been raised by $203.00 when noone's rent has been raised in 5 years. She sat right behind me to my right and said it and everyone heard it in astonishment. Not once but twice, mind you, so perhaps this is the "state of mind" the decent tenants here are dealing with?

My concern is just last night I wrote a note to management and slipped it under their office door alerting them that there is more garbage strewn out in the hallway, and had been laying there all weekend, and human waste perched on the aforementioned common hallway window. Apparently this morning the maintenance crew came and picked up the litter and cleaned the window. I've taken pictures of it and would "gladly" show them to you except attachments are not allowed.

Right now, just a day later, there is more trash strewn out there near the public radiator, right past where these ppl leave their apartment precisely at 7:10AM. I know it's precisely because they usualy make a thunderous racket egressing and degressing from their apartment. They're the only ones here with school-age children who would do such a thing. For instance, one of the little girls has taken to singing opera songs right outside my door at 7:10 AM as of late and she did so this morning.

I've observed and reported these ppl to management on several occassions for vandalism of corporate property, trying to drop the plaster walls, etc. So I left one note with management yesterday, I just slipped another one under their door again thanking them for cleaning up the garbage in the hallway yesterday, but right now due to the PATTERN of vandalism there is now more garbage strewn out in the hallway and this is school-age garbage, such as pencil shavings, colorful little stickers, candy wrappers, abc chewing gum, etc.

My concern is current management seems to be schmucky by telling me I'm "stalking" this woman by taking meticulous notes about all the times I've had to call security and police on her (approximately 15 times) solely because of this woman and said next time she may call HPD to evict ME, the victim of Quality of Life violations as an "Undesirable Tenant" because I want to live in a peaceful, destructive-free habitat as I've lived for so many years in the exact same apartment.

When management gets the note tomorrow is there any chance of them railroading ME as the transgressor because I'm reporting vandalism to corporate property, not naming anyone (because I'm *scared* to name them), and just trying to preserve and protect the interests of the 5 other decent tenants and families on this floor who are sick and tired of living in a recently brought on corporate pigsty?

Your prognosis was correct, Home Guru. How did you know?

Once again, the victim, me, gets labeled the culprit and I don't like it. What's worse, the LL starts spewing lies about this and that, then she says "you know your apartment hasn't been painted lately and the lease says you're supposed to paint it every 2 years." I have a big apartment here and to be forced to paint it would be a major, and unnecessary undertaking for me.

So the bottom line is I'm effectively gagged. I have to live in a pigsty, and this development has a reputation for clean halls. What a railroad, don't you agree? All this time the LL is near foaming at the mouth during her tongue-lashing of me, making ME out as the bad guy. But I think she knows I can only be pushed so far. At then end I said, "is that it?" and she says "yes."

I can't believe this, I can't believe any of this. It was never like this here. When my parents OBM were running this apartment something like this nonsense would never ever happen.

Then the LL starts saying, "oh, you really think this works in favor of your Succession Rights?" Now she's talking about my Succession Rights. They might toss me out of here yet.

If the rules state that you need to paint your apartment every two years, then you need to paint every two years. Why do you believe you should be exempt from the rules? After all, you are attempting to make sure others are being held strictly to them. You seem to be picking and choosing what rules are enforced and who is held to them.

You're correct, Ohiogal.

The only thing that bothers me is I've never been told that before, and I'm sure a lot of the other tenants don't paint their apartments every 2 years. Yesterday the LL seemed to pull it out of her hat. And I'm not surprised; the thing is I've never had any trouble here and I've seen these LL's come and go.

All of a sudden I've got trouble and it all boils down to these people next door. Whatever they do, I get blamed for. Someone here has the Stockholm Syndrome at my expense.

Thank you for this info, HomeGuru. I really don't want to sue anyone here, I just want to live a peaceful life here. I have a lawyer I found through FreeAdvice that I feel sorry for the HOA if I decide to sue.

What is HOA anyway? This particular development is administered by HPD which is Housing and Preservation Development, I believe.

And I found that lawyer right here through FreeAdvice. I saw him stop a helbent judge dead in his tracks trying to convict me for something I was totally innocent of, in a matter of malicous prosecution.

I'll never forget the look on that judge's face

I never had any trouble until these people got here. I'm talking about both the manager and these people next door.

One of the most ridiculous things this new manager said was I'm "stalking" the woman next door because I'm taking meticulous notes and keeping police reports. That comment has to take the cake so far.

And this woman next door, one bizarre comment after another. One of her "best" was Child Protective Services took her kids away because of me. i have never said a word to her kids, ever, and have had no dealings with them since they've lived here, which is about 7 years now. I think someone should tell this woman I am NOT her long-gone husband.
