Non-Performance of HOA/Board of Dir

I have over 20 blatant issues surrounding the negligence and lack of performance of our Declarant/Developer/President of the HOA Board of Directors - yes he is one and the same person. I also have examples of misappropriation of funds and HOA dues. What action can be taken to remove this person from the Board? Since he owns one lot in the neighborhood he becomes by default a member of the HOA. According to the bylaws, he is also the Declarant as long as he owns one lot. However, there must be some legal action to remove him from his Board title and duties? He has threatened dire consequences to anyone who files suit against him and vows to fight any suit to the bitter end. What advice do you have other than telling me to move?
