pet fees?What is the name of your state (only U.S. law)? MA Are charging unit owners who have pets EXTRA charges for cleaning legal??? the condo is trying to pass a "pet fee", so that anyone unit owner with a pet that uses common space be charged an annual extra fee of $100.00 can they do this and do I have to pay? Is it worth taking it to a lawyer??? Please advise. |

| Here in NJ, that wouldn't fly: ALL the members of the HOA MUST take equal part in ALL the expenses for ALL the common property. Charging the pet fee is like charging extra to use the pool; something which they can't do. Look in your By-laws, Public Offering Statement, as well as State Statutes for language that confirms this. You could even probably call an HOA Lawyer to find out if this is true in MA, as it is in NJ. Good Luck and keep us updated! |
