Problem with real estate agent

Hello,

First Post and thanks for listening. This is not a earthshaking problem but is fast becoming a pain for our board.
We have a real estate agent who has posted two identical signs on our property. This is in addition to 4 other For Sale signs. He has two properties for sale. They are identical with no other identification of the units...We have asked that he remove one. He has refused. He has been rude, impolite and arrogant...
Questions
1.Can we tell any realtor he cannot put ANY sign our association property if others are allowed?
2. Can we limit the number of signs any ONE realtor can place on our property?
3. If we cannot do 1 or 2 without a big legal hassle, can we tell any realtor where his sign will be placed and can we as an association place the signs anywhere we want on our property?

I know this is not the biggest problem of the week, but this is very frustrating and it looks like half our condo units are for sale. The fewer signs the better is our feeling.

You can dictate whatever rules you like regarding signs on "your" property, (as limited by the CC&Rs). Similarly, the Board controls what signs are in the common areas (again, as limited by any CC&Rs). Private owners also control what signs go on "their" property, as limited, if at all, by the CC&Rs.

So, exactly where are these signs?

Signs are all on common area in the grassy area by the street.
If there are no written rules regarding "realtor signs" (obviously this was never a problem before, so never addressed in writing) in the CC and Rs can the board just say "one sign only" and actually remove the other sign. In other words, does it all have to be in writing or can the board or board representative just tell him to take one sign down...

He "wants it in writing." Also, homeowner of one of his sale condos says one sign is enough and sees no need for two of identical signs...Thanks again...hope that answers your question....Ted

In my neck of the woods, sign placement is governed by the Associations. We are never allowed to place signs on the common areas. In your case, the homeowner is the boss and if he only wants 1 sign, the Realtor should comply.
