i live in a brand new, as of 4 years ago, 46 unit brick and steel foundation luxury condo complex in beverly,mass. building has Whalen central air conditioning with individual unit control and chiller tower on roof. the a/c is online all year even in the winter, continously since the building opened. many unit owners, including myself, need to use the a/c at various times during the winter for temp and humidity control, health and quality of life issues , plant maintenance etc. propery management wants to shut down the a/c for the winter because they say the chiller tower will freeze up (even though it hasn't freezed up in 4 years! do the condo owners have the right to keep their a/c for 365 days a year no matter what the bylaws may say especially since the unit owners very health and well being are at stake?What is the name of your state (only U.S. law)?

Are they intending to drain the chiller for the winter?
If not, turning it off most likely won't keep it from freezing up.

A ductless A/C unit would be a relatively inexpensive workaround if all else fails, if you can locate the exterior unit appropriately.
