Repair Assessment (Boiler)

I own a Condo. The Association along with the Management agreed to add an assessment charge to the monthly maintenance in order to fix the boiler that is long over due for repairs. As of November 2005, each unit owner is instructed to pay said amount based on the size of their unit. The said amount has been divided into monthly payments by management and will end June 2006. The said amount is equal to my monthly maintenance bill, and my monthly maintenance is hard already for me to keep current resulting in the inability to pay additional monies for assessments. I also recently received notice that the monthly maintenance will go up in January 2006 due to additional repairs.
The bottom line is this: I just received notice that The Board of Directors has given permission for Management to seek legal because I’m in arrears due to not paying my assessment fee; however I am current with my monthly maintenance fee. The Board never consulted with the unit owners before sending out a bill for assessment charges. Do the Board and/or Management have the legal right to contact legal regarding an assessment charge? This would be an action that will only add additional fees. Can additional fees be added when one is dealing with assessments?
