My HOA mailed me a request for mediation for an alleged violation. The mailman mis-delivered the certified letter to an unknown address in a black hole. I did not respond to the letter until a copy found it's way into my mailbox - a few days past the 20th day after the date of the letter.

Months later, a lawsuit was filed. I requested docs and management company refused saying everything related to the lawsuit was out of their posession and with the lawyer. I retained a lawyer. The HOA lawyer had no supporting docs. They withdrew the case before my lawyer could file a counter claim.

Am I entitled to the reimbursement for my legal fees? Lawyers are not cheap.
