Service Contracts


What is the name of your state? South Carolina

OK have what I think is a simple question. We live in a Condo unit which has a board and such but note this isn't a coop. Is a privately owned condo unit we own outright.

Now I guess awhile back not sure if before we purcharsed or not as the board never notifies the owners of impending contracts, but sometime back they apparently contracted for pest control service for each unit at a reduced rate.

Now problem is my wife and I hate the chemicals they use and do not want this service in fact we have stopped using them though we've been paying for service as it's worked into the monthly regime fees.

Now bare in mind I never approved the board to contract for pest control services on my behalf. Being this is a private unit can the board force us to pay for this service if we do not wish it?

My guess is no because this is a private unit and the boards power is blocked at the door to this unit except in very limited circumstances such as an emergency or should the owner say make a renovation that is harmful to the building and they need to fix this if the owner won't that type of entry but I would guess they can't enter into a contract for pest control services without the owners permission.

Their stance is they can and if we follow that stance alittle they could therefore contract to have an unit bug bombed forever and force the other owners to pay for it. See where this could lead into troubles.

So my guess is they don't have the legal power to contract for services inside a private unit unless in one of those limited circumstances.

if they can't legall do this and then force the owner to pay are there any court cases that cover this sort of issue that I can forward to our property administration company so they can send this to the board?

Thoughts on this as we want out of this.
