Sewer lines and tree roots, who's responsible?

What is the name of your state? California
We have a townhouse, the association has planted trees around our structure and the roots of their trees have gone through our sewer lines. They are refusing to pay for their trees damage, the work was done on the common area, not owned by us, but the sewer line goes to our structure. There is nothing in the CC&R rules regarding this situation. I would also like the trees taken down around our structure so this doesn't happen again. What should I do?

Your situation is not the 'normal' neighbor's trees caused problems, as the trees are partly yours (through your common property ownership). Also, your property line is likely the building line.... making insufficient area to remove the roots.

Document your claim in WRITING to the association for a solution to your problem... and compensation for the damage that their trees caused.
If that fails, your only recourse will be to consider a lawsuit.
