I recently purchased a newly built condo in Point Richmond, California where there are 4 older buildings in the development. I got a letter stating that the HOA wants a special assessment of $25,000 per owner for siding replacement for the 4 older buildings. The association knew about the siding back in 2002 while our building was being constructed. When purchasing our condo there was no disclosure telling us the new owners that we would be hit with this assessment. Is this legal? We want to get a lawyer and fight this. Do you believe that we have a case since this was not disclosed during the purchase? They could have easily gotten this done in 2002 but waited until know so that we the new home owners would have to help make their payments. We will get absolutely no benefits out of this matter.
