suing over wet basement

Hi. We bought a 100 year old house in April, 2004. It was our first house, and we had a terrible real estate agent. We had the home inspected, and the inspector said everything was fine. The owner declared that there had been water in the basement in the past, but that the problem had been corrected. The basement has leaked many times in the past year+ and we have HAD IT! It's been a while, but is it too late to hold the previous owner responsible for lying? One catch- he didn't live here for the six months or so previous to selling. BUT, he kept his dogs here and would have been in the basement, and there's sealing paint stuff in the basement cabinets that was here when we moved in. Please advise?

**A: did the home inspector say specifically that the basement was fine? Did the inspector say that there were signs of water infiltration in the past? What did the inspector tell you when you told him/her that there were leaks but the Seller claimed they were fixed? What exactly did the inspector write about the basement in the inspection report?

**A: and what was the form of such declaration? was in in writting via a seller disclosure statement? Did you ask how much water, when did this occur, was it a once time occurance or did it occur say multiple times. Who corrected the problem and if a licensed waterproofing contractor, did you ask for the name of the contractor and the license # and copies of the contract, plans and specifications and paid invoice? Did any engineer or waterproofing contractor inspect the basement? If so, did you ask for copies of the inspection reports?
