Question

Water Damage in Condo


What is the name of your state? New York

I live and own a condo on the second floor. The woman downstairs told me she had a leak in her ceiling below my shower. I had a plumber come in and it turned out to be a broken drain pipr under the shower. He fixed it and I called my insurance company to notify them of the damage my unit cause below. I just got a letter from my insurance company claiming they are not liable for the damage to the unit below me and won't pay. I'm worried that the owners below will come after me to get their money. Can they do this if my insurance company claims it's accidental? Also, won't her insurance cover her own damage, assuming she has insurance? Isn't there something about it being unintentional damage or accidental damage, basically nothing I could control as a home owner to prevent it that makes it no-fault? Help ease my mind....

First - how much damage was actually done?

Second - just because the insurance company says there is no coverage, that doesn't mean there is no coverage. You need to talk to your insurance agent/adjuster. Insurance companies deny legit claims all the time******************************************.

The damage to their ceiling required about a 2 ft. square section be cut open to repair the pipe above it. She hasn't gotten an estimate yet nor has she called her insurance company if she has one at all.

Aaaaaaand you are bothering your insurance company with the 2x2 damage to the drywall ceiling??? The broken drain would not usually be a covered item but the damage to the unit below should be....but, come on, what it that to fix??? $200??? Let her know you will have it fixed on your dime and that this is one of the things she has to tolerate in a stacked condo situation...pipes break.
