Water Damage in Condo-HOA refuses to help me gain access to neighbor's leaking P trap


What is the name of your state?What is the name of your state? California

There is a leak coming from the bathroom above my condo unit. I have had to cut a whole in my ceiling to allow the water to drip into a bucket. The HOA (after countless attemps) entered the unit above me, and their maint. dept. declared that the leak was coming from the P trap of my upstairs neighbers.

They have assigned responsibility to the neighbors above, and are totally hands off now!

The elderly neighbors upstairs ahve refused ANY contact with me. The woman has refused to open her door to let me even TRY to politely request their cooperation. The HOA said I would need access to this unit in order to successfully fix the leak, and will not help me gain access.

I have even offered to PAY for the ENTIRE repair process! HELP! What can I do?

**A: contact the building department to get an order of entry or sue the old folks to gain access.

More questions...


Can I really get someone to force entry? Cops?

I'm trying to think of everything I could possibly do to avoid having to sue them for entry.

Are HOAs..actually COAs really exempt from all responsibility in these situations?

Is knocking on their door everyday (without saying any threats..etc) considered harrassment?
