Built-in Swimming Pool filled


What is the name of your state? california

My sister bought a home a few years back, and had the yard totally redone, including filling in a swimming pool with dirt, plants, contract etc. You can't tell that there was even a pool there....Question: She is wanting to sell. Does she have to disclose to potential sellers that there is a pool underneath her pretty plants???

As far as she knows, the pool was never added to the property assessment, when it was put in. She said that when you run a history on the house it doesn't mention having a swimming pool.

If the new owners decide to build their own swimming pool, they will discover the old one and have to pay thousands of dollars to dig it out. They will then contact your sister to see if she was aware of this and then sue her for the additional costs.

Your sister is worried that disclosing the pool will decrease the value of her house - WELL THAT' S THE WHOLE POINT. It does decrease the value, and your sister knows about it so she has to disclose it.
