Can a (Mexican) repairman Assault you ?

On July 15 i signed a written contract with a roofer that he would replace the roof of my house with a very specific brand name high definition 30 year shingles - he worked on my house on July 15 all day with his crew - in the evening when i came home and saw the wrappers of another cheaper quality shingles in the dump truck and questioned him then he told me that that is the shingles he had put on the house - i refused to pay him and asked for the shingles which he had promised to me in the written contract - he left with his crew and never came back - i called him several times and left msgs for him as he will not take my calls - telling him to come back and put the right shingles which he promised - he never returned my calls and never came back - the contract expired on July 25 - Then Suddenly 3 months later he showed up in my neighborhood with 4 of his buddies and stopped my truck by blocking it with their automobiles. i locked my truck from inside and rolled the windows up - the contractor started to hit my driver side window with his bare hands and his buddies just stood there watched him do it all. i did not have my cell phone with me - i did gestures to a by stander to please call police - then one of contractor's buddy called police on his cell phone - but before the police arrived they all removed their automobiles from near my truck and parked them away and stood far away from my truck as they had not done anything - when police arrived i told police everything - the contractor who had fixed my roof will not come near me - but one of his buddy whom i had never seen before and who had nothing do to with the repair of my house came to police with his Id and told police that he had worked on my house - i told police the truth - policeman told me that since he did not see them assaulting my truck or me so he cannot arrest them and told the 5 people to pursue this case in the civil court and they are not to stop and block anyone from their freedom. all of the 5 people are Mexicans - i think that the person who worked on my roof is illegal and therefore he did not come forward to pursue the matter instead he had one of his buddies to come forward and tell police that he had contracted the roof with me - the policeman wrote the report that i did not pay them because i did not like the color of the shingles (which is not true - i told that to police officer that it is not the color but it is the quality of the shingles). i am so surprised that they have not filed any LEAN against my property and they have not gone to court yet because it has been more than a month since they had stopped me on the road - what should i do - should i just forget about it and move on with my life - will they come back again and try to hurt me physically - why dont they go to court and solve the issue and then we get to the end of it. i want to pay to the contractor but not the amount we wrote in the contract because that is the amount for the EXPENSIVE HIGH QUALITY SHINGLES - also if i go ahead and pay him somthing what guarantee do i have that they will not come back and try to sue me again. please advise in detail what should i do ? thanks for your help!

What does your contract with the roofer say about shingles?

My Contract Says ....


The Contract says that the Contractor will -
- put only Timberline Prestique 30 High Definition shingles on the roof
- Contractor is to paid only after the successful completion of the job
- Provide for all the LABOR and Materials needed for the roof

The Contract was signed on July 15 - he worked with his crew on July 15 only and never came back except on September 25 to assault me in my own neighborhood only 2 blocks away from my home.

The contract expired on July 25th, 2009

document everything you can and hire another contractor to do the work. Sue this contract for any additional work he caused the new contractor to charge you extra money for.

if the old contractor left any materials on site; put them away so they do not get damaged or stolen.

pictures, shingle wrappers, anything to show your side of the story is good to keep.
