Can not get repairs done, what to do? What is the name of your state (only U.S. law)? Orland, Florida
My wife and I bought an apartment/condo conversion in March 2007. On the final walk through I pionted out, and the developer noted, that there was rotting wood at the end of a truss protruding from the roof. We were told that they would fix it since we (the new owners) would be responsible for repairs inside our own units and that the developer (then the future HOA) would be responsible for repairs and maintenance of the outside of the building. Now over two years later there still has been no action taken to fix the rotting wood that is in really bad shape now. The management company that the developer hired said that they got an estimate and that it was too high and that they were going to continue to look around. Hurricane season is right around the corner again and we are afraid of possible damage to everything we have worked so hard for. WE think he I trying to stall to get the HOA started (with 70% of units sold) and have them fund the repairs. We are not even close to be having a HOA anytime soon do to the housing market. We pay high monthly dues and are frustrated at the lack of wilingness to do the much needed repairs. What legally can be done to push the issue? What is the name of your state (only U.S. law)? |
