common fence problem

hi there

i live in houston, i have a common fence with my neighbor. it was not bad. but because he replaced his other side fence he also replace the the common fence between us. and put all good looking side on his side and post on my side.

i have planted a vegetable next to fence on my side and i put a nail on fence to support the plant , my neighbor came to me and told me that " i can't put nail on his fence" so i took nails off the fence right away.

I don't want to fight with him but i I want to know "what is right under law?"

who is the owner of the fence? even if the fence is on common land?

i also notice that when he put the fence there are so many nails sharpe ends open my side. can i tell him to fix that nail so no one get hert on my side?
