What is the name of your state? texas we contracted to have a porch addition done within 2 weeks. it has been 14 weeks. construction started-roof removed from original house to tie in new roof of porch in august. no shingles on roof. house is water damaged. contractor has been paid 85% of job and 50% completed but will not answer calls. kept making promises to finish but has not kept his word. If we hire a new contractor, will that void the contract with con man and ruin our chances in small claims court? also, we want his insurance company to pay for the damages to our property from water. thanks, paul

a claims adjuster for his insurance has been to the house.

Sorry, I was trying to be brief. more info-he has refused to cooperate with insurance company;insurance agent said that there is a problem with his policy and he would have to pay most of repair work; he was upset and told agent to take a hike-that is when he abandoned us but we found him through some investigating-he went into a rage when we verified his new address with his landlord, called, threatened, used profanity-called today-made offer to complete roof of house, put skirting around porch, have inside fixed and leave out finishing porch and doing electrical. calling it even with what we have paid him, we are supposed to meet with him tomorrow-should we draw up a new contract stating in detail what is expected? we are willing to cooperate with what he suggested but given his history, we doubt his integrity.
