We had signed a contract and the contractor did most of the work

He had caused considerable damage to many new areas such as:
Crack and chips in new bathtub
Deep scratches in new wood floor (caused by compressor and workman stepping on nails, screws and staples) We can actually see what size staple, nails, and screws
Poor drywall work - every seam and screw was visable
poor cabinet installation

He asked for final payment and we refused- told him to finish work and then he would be paid

He just stopped coming to our house and we could not reach him by phone
We hired an attorney to contact him and to arrange for him to complete the job
He (and his attorney) never responded to any communication
We waited 4 months then had the work completed

Now ( 10 months since he walked out of the job) he is trying to sue us for non- payment

He will not accept our payment (final cost minus costs to finish/repair work , all is documented, and all was sent to him before we had the work done)

It has already cost us $4000 in attorney fees
Attorney General can't help us ( thay can't force him to negotiate)
Home Improvement Commision can't help us ( since we have not "paid" the final payment they rule it as a contract dispute)

Any suggestions?
