Contractor won't finish job

We have a signed contract to have our basement finished,the contractor was given $3000 up front, it has been 9 months and still not complete. There is no timeframe on the contract but it does state that the balance is to be paid at the completion of the job(our mistake). When the contractor wanted to rush and finish the job our balance was $2000, we only had $800 to give and we told him we would pay him the balance at the end of the month. Needless to say he would not go for it. Now we have the entire balance and he wants to get paid upfront before he completes the job, our fear is he will string us along like he did initially. We have taken pictures of the 3/4 completed job. We wanted to draw up a new contract with a timeframe but he does not want to do this, can we hire another person to complete the work without getting into legal trouble with the other contractor. I live in Illinois.
