Dirt Problems. Sue Developer or General Contractor(Builder)?


State: Wyoming.

My wife and I purchased a new construction house last fall from a general contractor. We are having serious issues with our concrete front 100 square-foot porch sinking and moving away from our house. This porch also supports part of our roof. It has moved about 3/4" away. The concrete in the garage has lifted approximately 2/3" right in the center of our garage. This all happened this spring when our house was under the general contractor's one-year warranty.

The developer of our area did all the dirt work. It's clear that the problem is dirt related. At this point, the developer says he won't fix anything unless it moves more than an inch. Can you believe it?! The general contractor says the problem is with the developer, but when we purchased the house, we paid the general contractor.

My question: Who do we go after? The developer who did the dirt work for the general contractor or the general contractor who happily took our money when we purchased the property and the house?

Also, is this a strong case? I would think so. The porch looks horrible.What is the name of your state (only U.S. law)?

yes but make it both just to be safe. Let the judge worry about which one, if either, isn't liable.
