Dispute with Window Guy


What is the name of your state (only U.S. law)? CA
We had some windows installed recently. In short, we were promised a few things (in writing by email before we signed the contract) that were not fulfilled - 1. were promised the windows we were ordering would qualify for an energy rebate (turns out they don't). 2. were told that the installation would be done by the window experts (him and his brother) and they ended up bringing day laborers.

This is a 10K job - the biggest grudge we have is that the windows don't qualify for the tax credit ($1500 loss). Obviously we will not do business with them again.

Question: Should we withold $1500 from their payment since they ordered the window we wanted but misrepresented the tax rebate issue?

What is the best first steps to handle this without involving lawyers and court?
