Fence Height Ordinance Unconstitutional?

California.

I live in Los Angeles. There is a city ordinance that a front fence can't be higher than 3 1/2 feet. We've been robbed 5 times, vandalized 2 times. I built an 8 foot fence. My neighbor turned me in to the city. They are saying I have to remove it or get a variance - which a friend did - it took him several years and cost several thousands of dollars and he said it was one of the most upsetting, trying experiences he's ever gone through.

My question is: Could this ordinance be unconstitutional in any way? To me, this falls under the right to bear arms. Since the constitution is not specific as to what arms are, I looked it up in the dictionary. One of the many definitions is - "To prepare oneself for warfare or conflict." Since the fence went up there has not been a robbery or vandalism.

Can anybody site any cases where property owners have a constitutional right to fence their property?

Thank you!!! What is the name of your state (only U.S. law)? California

It doesn't.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed

No.... because such a case does not exist.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Perhaps if you built a moat around your house and it was deep enough, they'd consider it a swimming pool, and then you would have to have it fenced in. Add one good drawbridge and you're good to go.
