We are in Minnesota had have recently purchased a home. We are planning some construction and in the process of having a full survey of the property for zoning it has been brought to our attention that the neighbor's chain link fence is on our property. We are planning a privacy fence and the post for the end of the fence is in the way. This neighbor initially refused our request to tie on to her fence or be on our property in any way and now refuses to speak to us because we are putting up a 6 foot fence.

Do we have to do any notification of our findings about her fence being on our property (it would be done in writing) and is she responsible for moving the fence if we demand so?

Once you have the new full survey and IF it shows that her fence is on your property, simply send her a Certified (RRR) letter demanding that she remove the fence that is on your property within 7 calendar days or you will have it removed and file suit against her for the cost of the removal.
