Found Pest/Dry Rot Infestation after Purchase of home

We purchased an older home 16 months ago, and had a complete home and pest inspection and a VA inspection. Recently we removed an old deck that had pretty rotted wood to replace it, and the construction people found severaly rotted wood with carpenter ant infestation that looked like it had been there for years. The damage is extensive, and we are wondering what legal rights we have and what path we need to pursue. We have already contacted our realtor, home owners insurance and mortgage company.
Any advice would be greatly appreciated. Thank you

How old is the home?

Would anyone have even been able to see the problem B4 you purchased? without of course tearing up the deck

The home was built in late 1960's. In our home inspection, the deck and the porch were found to have deteriorated wood, however our reality advised us that those were cosmetic items, not to be pursued or further negotiated or inspected. I think had we been advised to have a closer inspection of the deck, we would have been told what we later learned-the deck was not up to code, and the inner joist that was attached to the house had extensive fungus, and dry rot throughout. The rot has been there for so long that it has spread up through the walls, and when knocked on them, makes a hollow sound. ..so yes I think that this could have been identified during the inspection.
